A mobile phone sold on Facebook Marketplace in British Columbia was found to be fake 10 minutes after the transaction. The case reached the BC Civil Resolution Tribunal after the buyer filed a complaint. Complainant Derek Garner claims that the Samsung Galaxy S23 Ultra he bought from Indian national Kulwinder Khangura was a low-quality fake phone. Khangura also claimed that the smartphone was sold with a 'no refund' clause.
The transaction between Garner and Khangura took place on January 7, 2024. The smartphone was provided in a box labeled Galaxy S23 Ultra. It also had a serial number. But it was a fake phone. The tribunal confirmed that the phone was fake because the defendant failed to submit documents proving that the phone was not fake. The tribunal then ordered Khangura to return the $500 he paid for the smartphone to Garner and pay $29.27 in advance interest.
